A Portuguese transaction needs a Portuguese legal assessment

Procedures familiar in your country of residence may differ from those required in Portugal. The form of contracts, land register entries, documents and tax obligations need to be assessed under the Portuguese framework.

If you are buying

Before you commit, we review ownership, encumbrances and the available property documents. We identify information to confirm, including matters concerning planning status and use of the property.

We prepare or review the promissory contract, considering the initial payment, deadlines, agreed conditions and the authority of those involved. We support preparation for the purchase and coordinate with the necessary professionals and organisations.

If you are selling

We organise the sale documentation and check consistency between land register information, tax records and the available titles. We identify matters that may require regularisation and assist with the appropriate steps.

We review the terms, documents and representation of the parties. Where charges need to be discharged or other issues resolved, we coordinate the steps needed before completion.

Considering tax before completion

We review tax matters relating to the transaction, including IMT and stamp duty on acquisition and the treatment of any capital gains on sale. Tax residence, use of the property and the circumstances of the transaction need to be considered.

Where obligations arise in another country, we coordinate with qualified professionals in that jurisdiction. Portuguese procedures do not replace any obligations in the country of residence.

Completing the transaction and registrations

We prepare completion through the appropriate legal route and assist with registrations and procedures relating to the transfer. We explain which documents are needed and the sequence of steps so you can follow progress.

Managing the matter from abroad
